Apparently, the Crown Office has dropped proceedings against two gamekeepers in Scotland who were filmed trying to trap/kill birds of prey because the video evidence was filmed for the purpose of gathering evidence. Crazy

It seems evidence is only evidence if stumbled upon accidentally.

The inmates seem to have taken over the asylum.

Does this mean we cannot be prosecuted for theft (shoplifting) on the basis of security cameras in shops?
Or that we cannot be prosecuted for parking offences using fixed cameras?
Or that evidence from security cameras at football grounds is inadmissable?

I'm assuming the difference is between overt and covert surveillance, and the admissibility in legal proceedings of the latter when not carried out by police etc. You're under no illusion about being filmed in any of those situations you note. A similar distinction occurs with private individuals' recordings of phone conversations. If doing so is not made clear to the other party, then it would almost certainly be thrown out of court.

Does this would mean all evidence gathered by private dectectives or people / firms of that ilk is inadmissible?.

If you read page 3 of this week's COUNTRYMAN'S WEEKLY, I think you will find things were a little different than those in the original post here.

Do tell more!

Does this mean that unless there's one of those "Be aware there is CCTV recording in place here for your safety and security" notices posted somewhere such evidence is inadmissible?

Appreciate the legalisms but if you're filmed doing something illegal it does seem daft that such footage can't be used in evidence (unless it was honey trapping/entrapment etc)

Yes, please tell us the other side of the story. The weekly paper on field sports isn't something I would normally look to read. Shotguns tend to have different uses in urban areas.

By fluke, I've just had chance to see the report in the Countryman's Weekly, as I had to visit our local shops to buy cards/balloons etc as we've been invited tonight to see our 2nd granddaughter who became Sheffield born at 1.19am this morning.

It naturally took a different angle on the story, but didn't seem to vary significantly from the BBC report in terms of fact, in that it talked of crucial but inadmissible evidence.
