The big difference comes with the European Court of Justice.


I think you mean the European Court of Human Rights. The ECJ is part of the EU and we would leave that if we leave.

The ECHR is subscribed to by all European countries except Belarus. Leaving it would make us look like a dictatorship.

I believe the Tories have done a reverse ferret on this and apparently no longer want to leave it.


The EU recently suggested that after leaving the UK should continue to abide by ECJ rulings on the rights of EU citizens in the UK. That would be unacceptable.

ECHR:
The Tories have more than once suggested that parts of the ECHR be rescinded so that foreign criminals can be deported. The saga of Abu Hamza was an embarrassment, though in light of recent revelations one has to ask whether this was due to legalities or a simple lack of competence. Other countries appear to have much less difficulty in removing undesirables.

To say the UK would look like a dictatorship if it left the ECHR is a bit of an exaggeration, however. I don't think it was regarded as one when it signed up in 1953, especially as it played a large part in drafting it under the guidance of David Maxwell-Fyfe.
