Sensational, but it is the finding of the tribunal.

Re: [DonQuixote] Sacked for being black [In reply to] Can't Post or Reply Privately

Gillingham rapidly either need to hold their hands up and accept that he was discriminated against or, if they think that there was no discrimination involved, take it to appeal and fight it tooth and nail to the bitter end.

Trouble is going to appeal is expensive. But the reputational cost of not doing so may be worse.

Where I work we have people from a variety of ethnic backgrounds at all levels in the organisation. We seem to all work together well.

A few years back we had a case of racial discrimination brought. The member of staff concerned was someone who, irrespective of background, I wouldn't have trusted as far as I could have thrown him and was no good at their job.

Eventually he was sacked (almost unheard of where I work).

He took us to an Industrial Tribunal claiming unfair dismissal and racial discrimination. The local media picked up his story of being unfairly treated because of his colour. At the tribunal he had a lawyer who spoke passionately about the discrimination his client had faced.

When one of my colleagues was on the witness stand this lawyer accused her of treating his client badly because he was black.

My colleague looked at him and said "I'm black".

As this was self evidently true it made the lawyer look not merely wrong but stupidly wrong.

Fortunately, witness after witness came forward and testified against the sacked individual and the Tribunal upheld the dismissal.

But it cost the organisation a great amount of time and money and caused much stress and worry for the people accused of the maltreatment.

one thing this case made me think about is equality generally in pro football - it does n't exist

players of more value may get sent to a better surgeon
fall out with the boss - get humilated training with the youth team or on your own
equal pay? some don't play and get huge wages - others a full season on a fraction

employment law in this respect does n't apply

They're clearly not a racist club. If they were they wouldn't have employed black players in the first place. One line from the piece linked to above -"McCammon, a former Barbados international, became the highest paid player at the club when he signed in 2008".
Surely a racist club would pay black players less than white players unless the people running the club were black in which case it'd be the other way around.

The article did not mention Paul Scally (I think that's his name) who has a bad reputation as chairman of Gillingham. According to Programme Monthly he got rid of the (excellent) programme editor for no apparent reason and then installed his own son in the post, with the result being that mistakes started appearing in the programme.

Paul Scally was on local news tonight saying the matter is far from over but couldn't say much more for legal reasons.

I think most Gills fans accept that the club probably treated McCammon poorly. But because he's black? No way!
